General
All bids made on the Morgan Auction are governed by and subject to the
following terms and conditions of sale. By registering as a bidder and placing
a bid, you are accepting these terms and conditions. If you do not accept these
terms and conditions, in full, please do not bid.
Bids will only be accepted from a registered bidder with a bidder name and
password issued by Morgan Auction. When registering as a bidder, you warrant
that the information that you are giving is correct.
This information will not be passed to any third parties. You will be assigned
a bidder name and password of your choice - please do not disclose your
password to anyone else for security reasons.
Product Description
All descriptions of products in the Morgan Auction are as accurate as possible
(to the best of our knowledge). Any errors or omissions will be amended as soon
as possible; in some instances this may be during the auction. Morgan Auction
cannot accept any responsibility for any errors or omissions.
Status of equipment, product warranties and carriage charges are listed on each
individual lot. A full explanation of these definitions can be found later in
this document.
It is the responsibility of the customer to check suitability of goods prior to
bidding - Morgan Auction cannot make any guarantees as to suitability or
compatibility of any particular products in the sale.
Product Status
All individual lots have a description of their status - to avoid any
confusion, Morgan Auction use the following definitions:
Brand New - as it sounds, this is brand new product. We
further add whether this is in full retail packaging or for example OEM
packaging (ie plain boxed)
As New - this is new equipment but may have been repackaged,
have tatty or missing packaging. Where possible we elaborate as fully as
possible.
Factory Refurbished - these goods are generally as new (often
in original packaging) but have been refurbished by the manufacturer (or their
agents). Typically these originate from cancelled orders, returns etc.
Refurb - generally returns, demonstration and ex-lease
equipment - fully tested and refurbished. These items would normally show some
signs of wear and tear.
Second User - these are secondhand items, conditions will vary
and where possible will be stated fully on the individual lot description.
Pull - these are secondhand items removed ("pulled")
from a system - for example video cards, memory etc
Untested - these are items that for whatever reason we are
unable to test and cannot give any guarantee of working condition or otherwise
Faulty - these are products that have a known fault which will
be clearly stated on the individual lot description
Warranty Descriptions
12 Month Warranty - most new products will have a 12
month warranty, generally on a RTB (Return To Base) basis - it is your
responsibility to return the item to us for repair under warranty. In some
instances manufacturers may offer a further warranty such as on-site and this
will be stated in the lot description
3 Month RTB warranty - the item is guaranteed for a period of
3 months and it is your responsibility to return the item to us for repair
under warranty
30 Day RTB warranty - the item is guaranteed for a period of
30 days and it is your responsibility to return the item to us for repair under
warranty
DOA Warranty - this is a Dead On Arrival warranty, the product
is warranted to be working on delivery but no warranty can be given or implied
beyond this. You have 2 days to inform us of any problems with the item
No Warranty - the product is sold without warranty, no
warranty can be given or implied and no returns can be accepted
Where an item is covered by an RTB warranty, in all instances it is the
responsibility of the buyer to return the product for repair and collect it
afterwards. Morgan Auction can arrange this service through our couriers if
required - please enquire as to precise charges.
It is the responsibility to ensure that items returned are adequately packaged
and properly insured. Morgan Auction cannot accept any responsibility for items
damaged or lost in transit.
Bidding
All bids made in the Morgan Auction are legally binding and cannot be withdrawn
once they have been placed. Please ensure that you keep your password safe for
security reasons.
All bids made are exclusive of VAT and are subject to delivery charges.
All lots are sold without reserve
Each lot will be sold to the highest bidder at the end of the auction. The time
of the end of the auction is clearly shown on the Morgan Auction site.
In the event of a dispute arising over a lot, the dispute will be resolved in
such manner as Morgan Auction may determine. Morgan Auction further reserve the
right to refuse or reject bids in the event of a dispute.
If you are outbid by a higher bid which is subsequently removed for whatever
reason, Morgan Auction reserve the right to accept your bid.
Payment and Delivery
All bids made on Morgan Auction are exclusive of VAT which will be added to
your invoice at the prevailing rate (currently 17.5%). You will be provided
with a VAT invoice upon payment. There are no additional buyer' premiums in the
Morgan Auction.
At the close of an auction, you will be informed by e-mail that you have
"won" the lot and we will arrange payment, invoicing and delivery to
your registered address. If you wish to collect from our Greenford warehouse,
please make sure that you select this option when registering to bid
Delivery charges are not included in the bid price and will be added to your
invoice. The carriage band for each lot is clearly stated in the individual lot

When registering with Morgan Auction we ask you to enter your credit card
number. We will not charge any monies to your account until the end of the
auction. As all bids made are legally binding, it is your responsibility to
ensure that you have sufficient funds available on the credit card to make
payments for any bids made.
The delivery address must be the same as your registered credit card billing
address. If for some reason this is not possible, please contact us directly
and subject to security checks, we may be able to arrange delivery to an
alternative address.
In exceptional reasons we may accept payment by other means. Please contact us
direct if you need to make such arrangements.
Morgan Auction reserve the right to re-auction any goods not paid for in full
within five days of the close of the sale.
Morgan Auction will attempt to deliver all goods on time but cannot accept any
liability as a consequence of late delivery however caused.
In Conclusion
All sales from the Morgan Auction are subject to the law of the United
Kingdom.
These terms and conditions do not affect your statutory rights.
